Greetings from PixelGardenRaft ("we," "our," or "us"). These Terms & Conditions ("Terms") apply to your utilization of our yacht charter offerings and our website situated at pixelgardenraft.sbs (the "Service") coordinated by PixelGardenRaft.
By reserving a charter or utilizing our Service, you consent to comply with these Terms. Should you not agree with any segment of these terms, access to the Service is not permitted for you.
2. Service Overview
PixelGardenRaft offers a range of elite yacht charter services, which includes but is not confined to:
- Yacht rentals by the day
- Sunset sailing experiences
- Business retreats
- Exclusive events
- Extended yacht excursions
Our offerings are contingent upon availability and meteorological conditions. We maintain the privilege to alter or temporarily halt services as necessary.
3. Booking and Reservations
3.1 Booking Process
In order to finalize a charter, the following is required:
- A minimum age of 18 years
- Provision of valid and comprehensive details
- Advance payment as delineated in your reservation confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
A charter is only regarded as confirmed following the issuance of payment and our affirmative written response. We retain the entitlement to reject service to anyone according to our discretion.
3.3 Availability
Charter availability is dependent on vessel accessibility and appropriate climatic conditions. We shall strive to honor your preferred scheduling.
4. Payment Terms
4.1 Pricing
Pricing is presented in € and encompasses applicable taxes unless specified otherwise. Prices can be subject to modifications without prior notification.
4.2 Payment Schedule
- Initial Deposit: 50% of the entire charter cost payable at the time of reservation
- Remaining Balance: Due 48 hours in advance of the charter's start
- Supplementary charges (if applicable): Payable at the conclusion of the charter
4.3 Payment Methods
Payments are accepted via major credit cards, electronic bank transfers, and certified bank drafts. Transactions are secure and encrypted for your protection.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With notice exceeding 72 hours before departure: A refund is issued, less transaction charges
- Between 24 to 72 hours prior to departure: A refund of 50% is provided
- Less than 24 hours before departure: No refund is available
5.2 Weather Cancellations
In instances of weather deemed hazardous by our captaincy, two alternatives will be proposed:
- Transfer of the charter to an alternative date without incurring extra costs
- A full refund in case rescheduling proves impossible
5.3 Mechanical Issues
Should mechanical issues arise with the designated vessel, we will endeavor to supply a suitable substitute. In the absence of an alternative, a complete reimbursement will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests are required to:
- Heed all directives from the crew
- Utilize safety gear as indicated
- Disclose any health conditions impacting their security
- Stay within assigned areas aboard the yacht
6.2 Prohibited Items
The items hereunder are banned on board:
- Containers made of glass
- Illicit substances
- Weapons or firearms
- Non-approved pets
6.3 Conduct
Passengers are expected to maintain courteous conduct. A charter can be ceased prematurely without reimbursement if passengers engage in behavior that is either a safety hazard or disruptive to others.
7. Liability and Insurance
7.1 Our Liability
The extent of our responsibility is confined to expenditures paid for the charter. We are not liable for:
- Injuries due to passenger neglect
- Theft or damage of personal property
- Indirect or punitive losses
- Delays from weather or other external influences beyond our control
7.2 Insurance Coverage
Our operations and vessels are protected under comprehensive marine insurance. Passengers are advised to secure personal travel and belongings insurance.
7.3 Assumption of Risk
Engaging in our charter operations signifies your acknowledgment of inherent maritime-related perils and your acceptance of responsibility for your personal health and safety.
8. Modifications and Itinerary Changes
Modifications to itineraries, paths, or timetables, prompted by atmospheric circumstances, safety requirements, or operational demands are reserved by us. Efforts will be taken to offer alternatives of similar value.
9. Force Majeure
We do not hold accountability for hindrances, cancellations, or alterations caused by events beyond our control, including but not constrained to:
- Severe meteorological conditions
- Catastrophic natural events
- Legal enactments
- Port dismissals
- Technical malfunctions
10. Privacy and Data Protection
Your individual information is managed according to our Privacy Policy. Utilizing our services indicates consent to the gathering and usage of your data as specified in the said Policy.
11. Intellectual Property
Our web content, covering texts, imagery, emblems, and graphics are secured under copyright and trademark laws. Unauthorized copying, distribution, or creation of derivatives is prohibited without our express permission.
12. Governing Law
These Terms are subject to the jurisdiction of the laws prevalent in Spain. Legal disputes are to be resolved in tribunals within Barcelona, Spain.
